These Terms of Service (“Terms”) govern your access to and use of the services provided by Peakline.ai (“Peakline.ai,” “we,” “us,” or “our”), including our AI voice, website chat, Instagram and Facebook messaging, booking, and automation services (the “Services”). Please read them carefully.
By accessing or using the Services, or by authorizing others to do so on your behalf, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that business. If you do not agree, do not use the Services.
Peakline.ai provides AI-powered communication tools that help businesses respond to phone calls, engage website visitors, respond to Instagram and Facebook messages, qualify leads, and schedule appointments. The specific features available to you depend on the plan and configuration you select. We may add, modify, or discontinue features over time.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You are responsible for your authorized users and for ensuring they comply with these Terms. Notify us promptly of any unauthorized use of your account.
You are responsible for the accuracy of the business information, training materials, and content you provide, and for keeping it up to date. Because the Services respond on your behalf based on the information you provide, inaccurate or incomplete information may affect the responses generated. You are responsible for ensuring your use of the Services complies with all laws and regulations that apply to your business and your communications with customers.
You agree not to use the Services to:
The Services facilitate communications by phone, website chat, and social messaging. Where you enable features such as call recording or transcription, you are responsible for providing any notices and obtaining any consents required by applicable law in the jurisdictions where you and your customers are located. You are solely responsible for ensuring your communications, including recorded calls and automated messages, comply with applicable laws.
The Services may integrate with third-party products, such as calendars, CRMs, Meta’s messaging platforms, telephony providers, and automation tools. Your use of third-party products is governed by the terms and privacy policies of those third parties. We are not responsible for third-party products and do not guarantee their availability or performance.
Fees for the Services are described at the time of purchase or in the plan you select. Paid plans are billed on a recurring basis as described during signup unless otherwise agreed. Voice AI is offered under custom pricing based on your requirements. Unless otherwise stated in writing, fees are exclusive of applicable taxes.
You can change or cancel your plan in accordance with the process made available to you or by contacting us. Changes may take effect at the start of your next billing period. Except where required by law or expressly stated in writing, fees already paid are non-refundable.
The Services, including our software, technology, and branding, are owned by Peakline.ai and its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription, subject to these Terms. You may not copy, modify, reverse engineer, or create derivative works from the Services except as permitted by law.
As between you and Peakline.ai, you retain ownership of the business information and customer content you provide or that is generated through your use of the Services. You grant us the rights necessary to process that content to provide and improve the Services, as described in our Privacy Policy. You are responsible for having the necessary rights and permissions for the content you provide.
Each party may have access to non-public information of the other party. Each party agrees to use the other party’s confidential information only as needed to exercise its rights and perform its obligations under these Terms, and to protect it using reasonable care.
We work to keep the Services available and reliable, but we do not guarantee that the Services will be uninterrupted or error-free. The Services may be temporarily unavailable due to maintenance, updates, or factors outside our control.
The Services use artificial intelligence to generate responses. AI outputs may occasionally be inaccurate, incomplete, or not appropriate for a given situation. You are responsible for reviewing and overseeing how the Services are used in your business, and for applying human judgment where important decisions or sensitive matters are involved.
To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Peakline.ai will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.
You agree to indemnify and hold harmless Peakline.ai and its affiliates from claims, damages, and expenses arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
We may suspend or terminate access to the Services if you violate these Terms, if required by law, or to protect the Services or other users. You may stop using the Services at any time. Upon termination, the rights granted to you under these Terms will end, and provisions that by their nature should survive will remain in effect.
We may update these Terms from time to time. When we make changes, we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by applicable law, without regard to conflict-of-law principles. Any disputes relating to these Terms or the Services will be resolved as permitted by applicable law.
